1.1. WE WELCOME YOU TO TCI – TRAINING CENTER INTERNATIONAL

TCI   TRAINING CENTER INTERNATIONAL, (“TCI“, “Company”,  “we”  or  “us”) provides you with its Services (as described below) through its website at www.fashionacademyonline.com and  through its mobile applications, as well as other interaction properties owned and operated by TCI  (collectively, the “Site”). ), which are the subject of these Terms of Use. The fashionacademyonline.com Site  is an online  portal for professionals and creative enthusiasts. The Site allows users to: access and/or purchase courses available on the Site; publish photos; images and videos; share comments, opinions and ideas; promote their works and participate in contests and promotions (collectively, such services, including any new features and applications, and the Site, the “Services”). The Services include, but are not limited to, any services and/or content that TCI has made available or performed for you, as well as the offering of any material displayed, transmitted or performed on the Site.

 

1.2. ACCEPTANCE OF THE TERMS OF USE

These Terms of Use are entered into by you and TCI TRAINING CENTER INTERNATIONAL. The following terms and conditions, together with any document expressly incorporated by reference (collectively “Terms and Conditions of Use”), govern your access to and use of the Services, whether as a guest or as a registered user. Please read the Terms of Use carefully before you start using the Services. By using the Services and accessing the Site, you agree and agree to be bound by and comply with these Terms of Use and our Privacy Policy, available at https://fashionacademyonline.com/privacy-policy-fashion-academy, incorporated herein by reference. If you do not agree to these Terms of Use or the Privacy Policy, please exit this page immediately without accessing or using the Services.If you are using the Services on behalf of a business, that company also agrees to these Terms of Use.

We may revise and update these Terms of Use from time to time in our sole discretion. If we make changes to these Terms of Use, depending on the nature of the change, we will post the changes on this page, indicating at the top of this page the date of the last revision of these terms and/or notify you through the user interface of the Services, through an email notification or through other appropriate means and as required by applicable law. Such changes will become effective no sooner than fourteen (14) days after they are posted, except for changes to new features of the Services or changes made for legal reasons, which will take effect immediately. TCI TRAINING CENTER INTERNATIONAL reserves the right to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. You agree that TCI TRAINING CENTER INTERNATIONAL shall not be liable to you or any third party for any modification, suspension or discontinuance of the Services. We will not be liable if, for any reason, all or part of the Services are unavailable at any time or for a certain period. From time to time, we may restrict access to all or some parts of the Services to users, including registered users. We reserve the right to disable any username, password or other identifier, chosen by you or provided by us, at any time in our sole discretion for any reason or without reason, even if, in our opinion, you have violated any provision of these Terms of Use. The Services are accessible worldwide, but this does not mean that all Services or features of the Service are available in your country, or that User Contributions (as defined below) available through the Services are legal in your country. TCI TRAINING CENTER INTERNATIONAL may block access to certain Services (or certain features of the Service or certain content) in certain countries. It is your responsibility to ensure that your use of the Services is legal in the country in which you live. The Services are not available in all languages. The Services are only available to users over the age of 16; however, if you are under the age required to consent to use the Online Services in the country where you live, you may not use the Services, but you may invite a parent or guardian to open an account and help you access the appropriate content. If you are under the age of consent to use the online services, you will not be able to access the Services. If we discover that you have created an account in violation of these rules, we will close your account.

 

2.2. REGISTRATION

If you provide information that is untrue, inaccurate, not current or incomplete, or if TCI TRAINING CENTER INTERNATIONAL has  reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, TCI TRAINING CENTER INTERNATIONAL has the  right to suspend or terminate your account and refuse any current or future use of the Services (or any part thereof). You agree that all information you provide to register for the Services or otherwise, including, but not limited to, through the use of any interactive feature, is governed by our PRIVACY POLICY;  you also consent to all actions taken by us with respect to your information in line with our Privacy Policy.

 

2.3. ACCOUNT SECURITY

If you choose, or are assigned, a username, password or any other information as part of our security procedures, you must keep such information confidential and must not disclose it to any other person or entity. You also acknowledge that your account is personal to you and agree not to provide other people with access to the Services or any portion thereof through your username, password or other security information. It is your responsibility to keep your login credentials secure; In addition, you are solely responsible for all activities that occur through your account. You agree to notify us immediately of any unauthorized access to or use of your username or password or any other breach of security. You also agree to ensure that you log out of your account at the end of each session. You should take special care when accessing your account from a public or shared computer to prevent others from being able to view or record your password or other personal information. TCI TRAINING CENTER INTERNATIONAL  shall not be liable for any act or omission by you, including any damages of any kind suffered as a result of such acts or omissions.

  1. USER BEHAVIOR

3.1. USE OF THE SERVICE

The Site and the Service are for personal, non-commercial use only. Unless expressly authorized otherwise in writing by TCI TRAINING CENTER INTERNATIONAL, you agree not to display, distribute, license, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, transfer or upload for any commercial purpose, any part of the Services, use of the Services, or access to Servizi.Il Service shall not be considered usable or reliable for the  Storage of photographs, images, videos, sounds or any other content uploaded by the user, who must keep copies of all content published on the site. We are under no obligation to retain any User Content for any period of time beyond what may be required by applicable law.

 

3.2. PROHIBITED USES

You agree not to use the Services for any purpose that is unlawful or prohibited by these Terms of Use, or any other purpose not reasonably foreseen by TCI TRAINING CENTER INTERNATIONAL. By way of example and not limited to, you agree not to use the Services:

  • In a manner that violates any applicable local, state, national or international law or regulation.
  • To (or attempt to) abuse, harm, harass, threaten, impersonate or intimidate any person.
  • To send, knowingly receive, upload, post, download, use or reuse any material or content that: (i) contains any unlawful, defamatory, obscene, indecent, abusive, abusive, harassing, violent, hateful, inflammatory or otherwise objectionable material; (ii) promotes sexually explicit or pornographic material, violence or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; (iii) infringes any patent, trademark, trade secret, copyright or other intellectual property or other right of any person or entity; (iv) violates the legal rights (including rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or otherwise conflicts with these Terms of Use; (v) is likely to deceive any person; (vi) promotes any illegal activity, or supports, promotes or assists any illegal act; (vii) causes disturbance, discomfort or unnecessary anxiety or is likely to upset, embarrass, alarm or annoy any other person; (viii) pretends to be any person, or misrepresents your identity or affiliation with any person or organization; (ix) involves commercial or sales activities, such as contests, sweepstakes, and other sales, barter, or advertising promotions; or (x) gives the impression that they originate from or are endorsed by TCI TRAINING CENTER INTERNATIONAL or any other person or entity, otherwise.
  • To transmit, or obtain the sending of any advertising or promotional materials, including “junk mail”, “chain letters”, “spam”, or any other similar solicitation; collect or collect other users’ email addresses or other contact information from the Services by electronic or other means for the purpose of sending unsolicited email or other unsolicited communications.
  • To impersonate or attempt to impersonate TCI TRAINING CENTER INTERNATIONAL, an employee  of TCI TRAINING CENTER INTERNATIONAL, another user or any other person or entity (including, without limitation, through the use of email addresses or usernames associated with any of the foregoing) or otherwise misrepresent your affiliation with any person or entity.
  • To create multiple accounts for the purpose of favoring (i.e., giving a “like” rating) for or against your projects, to artificially inflate or alter “likes,” comments, etc., or to give or receive money or other compensation in exchange for “likes,” or to participate in any other organized effort likely to artificially alter the results of the Services.
  • Engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or that, as determined by us, may harm TCI TRAINING CENTER INTERNATIONAL or users of the Services, or expose them legally.

 

In addition, you agree not to:

  • Circumvent any measures we use to prevent or restrict access to the Services.
  • Use the Services in any manner likely to disable, overburden, damage, or impair the Services or interfere with others’ use of the Site, including their ability to engage in real-time activity through the Site.
  • Use any robot, spider or other automatic device, process or means to access the Services for any purpose, including monitoring or copying any materials on the Services.
  • Use any manual process to monitor or copy any material on the Services, or for any other purpose not expressly authorized in these Terms of Use, without our prior written consent.
  • Use any device, software or routine that interferes with the proper working of the Services.
  • Introduce viruses, Trojan horses, worms, logic bombs or other malicious or technologically harmful material.
  • Obtain, attempt to obtain or otherwise obtain any materials or information through any means not intentionally made available or arranged through the Service.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any portion of the Services, the server on which the Services are stored, any server, computer, or database connected to the Services, or to the private accounts of other users.
  • Attack the Services through a DoS attack or a distributed DoS attack.
  • Otherwise attempt to interfere with the proper working of the Services.

TCI TRAINING CENTER INTERNATIONAL has the right to remove any content that violates the Terms of Use or is otherwise objectionable. If you suspect that there are violations of these Terms of Use (other than those relating to copyright infringement notifications, as described below), please contact us through our contact page.

 

  1. DISPUTES BETWEEN USERS

You agree that you are solely responsible for your interactions with any other user in connection with the Service, and TCI TRAINING CENTER INTERNATIONAL shall have no liability in this regard.  TCI TRAINING CENTER INTERNATIONAL reserves the right, but has no obligation, to be involved in any way in disputes between you and any other user of the Services.
